1. Who we are

Spark Security Estate is a property care and management service operated by Spark Security Solutions Limited, Company No. 16333958.

Spark Security Estate provides property care, maintenance support, inspections, access coordination and related services primarily for landlords, HMO owners, property investors, commercial property owners and other property clients.

Our principal service area includes Manchester and Greater Manchester, with other areas considered depending on the service required.

2. Scope of these Terms

These Terms apply to your use of the Spark Security Estate website and, unless separate written terms have been agreed, to property care or related services requested from us.

Additional terms may apply to individual quotations, Property Care Plans, maintenance works, inspections, specialist services or other assignments.

Where a written quotation, service agreement or contract contains specific terms that conflict with these general Terms, the specific written terms will take priority for that service.

3. Our services

Depending on the instruction agreed with the client, Spark Security Estate services may include:

  • general property maintenance and minor repairs;
  • reactive maintenance coordination;
  • planned and preventative maintenance;
  • property inspections and reports;
  • void property and between-tenancy support;
  • key holding and property access coordination;
  • landlord and HMO property care;
  • property compliance coordination;
  • contractor and specialist trade coordination;
  • commercial property care;
  • ongoing Property Care Plans; and
  • other property-related support agreed with the client.
The exact scope of any service is determined by the quotation, instruction, Property Care Plan or other written agreement applicable to that work.

4. Quotes, estimates and instructions

Where appropriate, we may provide a quotation or estimate before work begins.

  • A quotation is based on the information available when it is prepared.
  • An estimate is an indication of likely cost and is not necessarily a fixed-price quotation.
  • Additional work identified after access to the property may require further approval.
  • Where circumstances differ materially from those described by the client, we may revise the scope, cost or timescale.
  • Quotations may have an expiry period stated on the quotation itself.

Work should not be treated as authorised until we have received the required client instruction or approval.

5. Property access, keys and appointments

The client is responsible for ensuring that we have lawful and appropriate authority to access the property for the agreed purpose.

Where keys or access arrangements are provided to us, they will be used only for authorised property-related purposes.

  • Clients must provide accurate access instructions.
  • The client is responsible for obtaining any necessary occupier, tenant, landlord or third-party permissions.
  • We may be unable to complete a visit where safe or lawful access cannot be obtained.
  • Additional attendance costs may apply where an appointment cannot proceed because access has not been provided as agreed.

6. Repairs and maintenance

Maintenance work may reveal defects or additional issues that were not visible or reasonably identifiable before work began.

Where additional work is required, we will normally seek client approval before carrying out work outside the agreed scope, unless immediate action is reasonably necessary to address an urgent safety or property protection issue and we have authority to act.

Completion dates and attendance times may depend on property access, parts availability, contractor availability, weather conditions and other factors outside our reasonable control.

7. Contractors and specialist services

Some work may require qualified, competent or specialist tradespeople.

Spark Security Estate may coordinate suitable contractors or specialist providers where this forms part of the agreed service.

Electrical and security work may, where appropriate, be delivered through the specialist capabilities of Spark Security Solutions Limited or other suitably competent providers.

Where an independent third-party contractor contracts directly with the client, that contractor’s own terms may also apply.

8. Compliance coordination

Where we provide compliance coordination, inspection reminders, document tracking or contractor coordination, our role is to assist with the organisation of relevant property requirements.

Unless expressly agreed otherwise in writing, this does not transfer the property owner’s, landlord’s, employer’s or other responsible person’s legal obligations to Spark Security Estate.

The client remains responsible for determining which statutory, licensing, safety, insurance or other requirements apply to their property and circumstances.

9. Property Care Plans

Spark Security Estate may offer ongoing Property Care Plans, including Essential, Professional, Portfolio or individually agreed arrangements.

The services included in a particular plan will be stated in the applicable plan description, quotation or agreement.

A Property Care Plan does not mean that all repairs, materials, specialist services or third-party contractor costs are automatically included unless this is expressly stated in writing.

Portfolio arrangements may be adapted to the number, type and requirements of properties under the client’s instruction.

10. Fees, costs and payment

Fees and payment terms will be stated in the relevant quotation, invoice, service agreement or Property Care Plan.

Unless expressly stated otherwise, additional materials, specialist contractor charges and work outside the agreed scope may be charged separately.

The client agrees to pay valid invoices in accordance with the payment terms shown on the invoice or other applicable agreement.

We reserve the right to suspend non-essential or ongoing services where invoices remain overdue, subject to any applicable contractual or legal requirements.

11. Cancellation and rescheduling

If you need to cancel or rearrange a booked visit, please provide as much notice as reasonably possible.

Where costs have already been incurred, materials have been specially ordered, contractor charges have been committed, or a visit is cancelled at short notice, reasonable charges may apply where permitted by law and the applicable agreement.

Any statutory cancellation rights available to consumers are unaffected by these Terms.

12. Client responsibilities

The client agrees to:

  • provide accurate and relevant property information;
  • disclose known hazards or access restrictions;
  • provide lawful authority for requested works and property access;
  • obtain required tenant, occupier or third-party permissions where applicable;
  • provide timely decisions and approvals where required;
  • pay agreed charges in accordance with applicable payment terms; and
  • notify us of material changes that could affect the work or property.

13. Urgent and emergency requests

We may provide urgent property support where availability allows.

Contacting our urgent or WhatsApp number does not guarantee immediate attendance or a specific response time unless this has been expressly agreed as part of a service contract.

Where there is an immediate threat to life, fire, serious crime or another emergency requiring the emergency services, you should contact the appropriate emergency service directly.

14. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

We are not responsible for losses caused by inaccurate information supplied by the client, unauthorised instructions, pre-existing property defects or matters outside the agreed scope of our services.

We are not responsible for delays or failures caused by circumstances outside our reasonable control, including severe weather, utility failures, restricted access, supply-chain disruption or contractor availability.

Nothing in these Terms affects any statutory rights that cannot lawfully be excluded or restricted.

17. Changes to these Terms

We may update these Terms from time to time to reflect changes to our services, website, business operations or legal requirements.

The current version will be published on this page with an updated revision date.

Changes will not retrospectively alter an existing written contract unless permitted by that contract or agreed with the client.

18. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales.

If you are acting as a consumer, nothing in these Terms deprives you of any mandatory rights or protections available under applicable law.

For business clients, subject to any separate written agreement, the courts of England and Wales shall have jurisdiction in relation to disputes arising from these Terms or our services.
